Arkaik ve Klasik Dönem Roma Ailesinde Çocuk ve Yeni Doğan Bebeğin Terk Edilmesi Meselesi

Abstract

Romalıların kabul ettikleri efsanevi kuruluş hikâyesinin kahramanları: Romulus ve Remus kardeşler. Onlar da terk edilen ve mucizevi bir şekilde hayatta kalmayı başarmış yeni doğmuş bebeklerdi. Romalı tarihçi ve hukukçuların ayrıntılı olarak tartışmadıkları "yeni doğan bebeğin terki" meselesi, demografik bakımdan önem taşıması yanında; sosyolojik ve hukuki olarak da değerlendirilmesi gereken bir konu. Bu meselenin mümkün olduğunca iyi anlaşılabilmesini sağlamak için, çalışmamızda, önce Roma ailesine ve Romalı çocuğun hukuki durumuna kısaca değinmenin faydalı olacağı düşünülmüştür. Ardından çağdaş toplumlarda da var olan ve benzer nedenlerle gerçekleşen "yeni doğan bebeğin terki"; sebepleri, etkileri ve sonuçları bakımından değerlendirilmiştir

The protagonists of the legendary foundation story that Romans accept: Romulus and Remus brothers. They were also newly born babies who were abandoned and survived in a miracle way.The issue of “abandonment of newborn babies”, which was not discussed in detail by the Roman historians and jurists, is not only of demographical importance, but also a subject that should be evaluated from sociological and legal aspects. In order to ensure that this subject be understood as fully as possible, we thought that it would be useful to begin our work with touching briefly upon the Roman family and the status of the Roman child. Subsequently, the “abandonment of the newborn baby”, which also exists in modern societies with similar reasons, was evaluated in terms of its reasons, effects and consequences
