Uluslararası hukukta erga omnes kavramının doğumu ve Gelişimi

Abstract

Bu çalışmada uluslararası hukuktaki erga omnes yükümlülükler kavramının içeriği ve hukuki etkilerine ilişkin hususlar üç bölümde incelenmiştir. Birinci bölümde erga omnes yükümlülüklere ilişkin kavramsal bir çerçeve çizilmesi amaçlanmıştır. İkinci bölümde erga omnes yükümlülükler doğuran normların uluslararası hukukun kaynakları arasındaki yeri ve kaynaklar hiyerarşisine etkisi değerlendirilmiştir. Üçüncü bölümde ise erga omnes yükümlülüklerin hukuki etkileri, jus cogens nitelikli normlarla birlikte uluslararası sorumluluk hukuku bağlamında değerlendirilmiştir. Erga omnes yükümlülükler, günümüz uluslararası hukuku açısından önemli bir aşamayı temsil etmektedir. Klasik uluslararası hukukun temel kavramlarının sorgulanması ile ortaya çıkan kavramlar arasında değerlendiren erga omnes, bir taraftan uluslararası hukukun emredici normlarının hukuki etki doğurması açısından zorunlu bir ihtiyaca cevap verirken diğer taraftan jus cogens kavramı ile uluslararası sorumluluk hukukun dönüşümünün temelini oluşturmuştur. Erga omnes yükümlülükler, iki taraflı sorumluluğa yol açan yükümlülüklerden farklı olarak bir bütün olarak uluslararası topluluğa yönelik yükümlülüklerdir. Bu yükümlülüklerin koruduğu değerler tüm uluslararası toplumun menfaatini oluşturan değerlerdir. Erga omnes yükümlülükler, aynı zamanda uluslararası hukukun emredici bir normunun ihlali nedeniyle ortaya çıkan yükümlülüklerdir. Bu kavram ile uluslararası hukukun emredici bir normunun ihlalinden doğrudan zarar görmeyen devletlerin ihlalde bulunan devletin sorumluluğuna başvurması mümkün hale gelmiştir. Zira, jus cogens nitelikli normların koruduğu değerler o kadar önemlidir ki bu değerlerin korunmasında uluslararası toplumu oluşturan tüm devletlerin menfaati bulunmaktadır.

This study examines the content and legal effects of the concept of erga omnes obligations in international law in three parts. The first part aims to draw a conceptual framework on erga omnes obligations. In the second part, the place of norms giving rise to erga omnes obligations among the sources of international law and their impact on the hierarchy of sources are evaluated. In the third part, the legal effects of erga omnes obligations are evaluated in the context of international law of responsibility together with jus cogens norms. Erga omnes obligations represent an important stage in contemporary international law. While erga omnes, which is one of the concepts that emerged with the questioning of the basic concepts of classical international law, responds to a compulsory need in terms of the legal effect of the mandatory norms of international law, it has also formed the basis of the transformation of international liability law with the concept of jus cogens. Erga omnes obligations, unlike obligations giving rise to bilateral liability, are obligations towards the by the international community of states a whole. The values protected by these obligations are the values that constitute the interest of the entire international community. Erga omnes obligations are also obligations arising from the violation of a peremptory norm of international law. With this concept, it has become possible for states that are not directly harmed by the violation of a peremptory norm of international law to invoke the responsibility of the violating state. This is because the values protected by jus cogens norms are so important that all states constituting the international community have an interest in protecting these values.
