Abstract
Anayasanın 127. maddesine göre mahalli idareler il, belde ve köy halkının mahalli müşterek ihtiyaçlarını karşılamak üzere kurulmaktadır. Bu bağlamda mahalli idarelerin anayasal olarak görevleri mahalli müşterek ihtiyaçları karşılamakla sınırlı olmalıdır. Bu durum aynı zamanda mahalli idareler ile merkezi idare arasındaki görev ve yetki ayrımının belirlenmesi açısından da oldukça önem teşkil etmektedir. Bu sebeple kavramın içeriğinin doldurulması söz konusu görev ve yetki ayrılığının nasıl giderilebileceği hakkında da fikir verecektir. İşte bu çalışmanın amacı, mahalli idarelere karşılama görevi olarak verilen mahalli müşterek ihtiyaçların bir bütün olarak düzenlenen mahalli idareler sistemi gözetilerek incelenmesi, merkezi idare ile mahalli idareler arasında görev ve yetki paylaşımının nasıl olacağı ve doktrin ve Anayasa Mahkemesi kararları ışığında kavramın içeriğinin belirginleştirilmesidir. Bu doğrultuda, öncelikle mahalli idarelere hakim olan Anayasal ilkeler ve temel kavramlar incelenmiş, mahalli idarelerin görev ve yetkilerinin belirlenmesine ilişkin ilke ve ölçütler ele alınmıştır. Daha sonra mahalli müşterek ihtiyaç kavramının Anayasa Mahkemesi tarafından yapılan tanımı irdelenmiş ve içeriği belirginleştirilmiştir. Son olarak ise mahalli müşterek ihtiyaç kavramı, Anayasa Mahkemesi kararları ışığında çeşitli yönleri ile nasıl somutlaştırıldığı incelenmiştir.
According to Article 127 of the Constitution, local administrations are established to meet the local common needs of province, town and village people. In this context, the constitutional duties of local administrations should be limited to meeting local common needs. This situation is also very important in terms of determining the distinction between duty and authority of local administrations and central government. Therefore, filling out the content of the concept will give an idea about how to resolve the task and authority. The aim of this study is to examine the local common needs given as a duty to meet local administrations by considering the local administration system as a whole, to share the duties and powers between the central administration and local administrations and to clarify the content of the concept in the light of doctrine and Constitutional Court decisions. In this context, first of all, the constitutional principles and basic concepts that rule over the local administrations were examined and the principles and criteria for determining the duties and authorities of local administrations were discussed. Furthermore, the legal definition of the concept of local common needs concluded by the Constitutional Court has been examined and its content has been clarified. Finally, the concept of local common needs has been examined to concrete aspects of various aspects in the light of the decisions of the Constitutional Court.
