İÇTİHAT TARTIŞMALARI ÇERÇEVESİNDE İÇTİHADIN TECEZZİSİ SORUNU İctihad, fakihin şer'î hükümle ilgili zannî bilgi elde edebilmek için bütün gücünü sarfetmesidir. Bu kavram fıkıh ilminin merkezinde yer almaktadır. İctihad faaliyetinin en önemli noktası ise ictihad ehliyetidir. İctihadın tecezzîsi, fıkhın bir meselesini delilleriyle bilen kişilerin o mesele hakkında ictihad edip edemeyecekleri ile ilgilidir. Bundan dolayı ictihadın tecezzîsi konusu ictihad ehliyeti ile ilgili yapılan tartışmaların odak noktasında yer alır. Konu ictihad ehliyeti ve taklid konusuyla doğrudan bağlantılıdır. Bu çalışmada ictihadın tecezzîsi meselesi, ilgili olduğu konular ışığında ele alınmıştır. Ayrıca ictihadın tecezzîsi kavramının doğuşu ve geçirdiği süreç incelenmiş, daha sonra da ictihad ehliyetinin şartları açıklanmış ve usûlcülerin bu konuyla ilgili görüşleri delilleriyle beraber ele alınmıştır. This consept to takes a place center of the jurisprudence. The most important issue of the ijtihad activity is ijtihad capability too. The divisibility of the ijtihad relates to ability of ijtihad of experts who understand a matter of the jurisprudence with arguments. Therefore the subject of divisibility of ijtihad takes a focus point in the discussions of ijtihad capability. The subject matter connects with the ijtihad ability and taqlid. The issue of divisibility of ijtihad has been investigated in the thesis in the light of subjects that relates its. However origin and process of the divisibility of the ijtihad were searched, then conditions of the ijtihad capability was explained and opinions of the usulists relates to this subject with proofs were studied.
