1760 numaralı samsun şer’iyye sicili 1267-1275/ 1850-1859 (değerlendirme, transliterasyon ve dizin)

Abstract

Hazırlamış olduğumuz numaralı ve 1850–1859 (H.1267–1275) tarihlerini ihtiva eden Samsun Mahkemesine ait Şer‘iyye Sicil Defteridir. Çalışmamız giriş ve metnin transliterasyonundan oluşmaktadır. Giriş bölümü kendi içinde ikiye ayrıldı ve birinci kısımda Osmanlı Mahkemesi, Kadı ve Şer‘iyye Sicil defterlerinin tanıtımına teşebbüs edilmiş, özellikle defterlerin fiziki durumları, katalogları, toplam sayıları, hususiyetleri ve öbür yandan tarih yazıcılığı, kültür tarihi, hukuk tarihi, şehir tarihi incelemeleri ve askeri tarih vs. gibi sahaları bakımından ehemmiyetleri tasvir edilmeye çalışılmıştır. Ayrıca, defterlerin bugünkü durumu, önemi ve bunlara dayalı olarak çeşitli bilim disiplinlerine mensup araştırmacıların çalışmaları da kabaca ele alınmıştır. Giriş bölümünün ikinci kısmında ise Samsun’a ait Şer’iyye Sicil defterleri ve bunlar üzerinde yapılan çalışmalar belirtilmiş ve 1760 numaralı Samsun Şer’iyye Sicil Defterinde geçen hükümlerin özetleri verilip defterin değerlendirilmesi yapılmıştır. Değerlendirmede Samsun’un kazaları, köyleri, mahalleleri, halkın kullandığı eşyalar, giydikleri elbiseler, geçim kaynakları, iktisadî ve ictimaî vaziyetleri üzerinde durulmuş ve giriş bölümde kullanılan çalışmalar bibliyografyada belirtilerek asıl metnin çevriyazısına geçilmiştir. Metnin çevriyazısında basit transliterasyon kaideleri dikkate alınmıştır. Son olarak çevriyazının dizini hazırlanmış ve özellikle mekan ve şahıs isimleri ile ıstılahlar yanında, Samsun halkının kullandığı eşyalar, yetiştirdiği ürünler, giydikleri elbiseler, besledikleri hayvanlar, yetiştirdikleri bitkiler, menkul ve gayri menkuller dahil edilerek tez çalışmasına nihayet verilmiştir. yye Sicil Defteri, Samsun, Mahkeme, Kadı, İslam Hukuku, Türk Hukuk Tarihi, Osmanlı Hukuku.

This postgraduate thesis that we prepared and is registered in no. 1760, including between the dates 1850-1859 (A.H. 1267-1275) is the Shariyya Registration Book that belongs to the Court of Samsun. It's composed of a preface and the transliteration of the text. The preface is divided into two. In the first part the Ottoman Court, Qadi and Shariyya Registration Books were attempted to be told, especially the physical condition of the books, their categories, total number and features; on the other hand the importance of the books from the history writing, history of culture, of law, studies of city history and military history etc. points of view were tried to be described. Also the recent condition of the books, their importance, and basing on these many studies from researchers of various disciplines were taken up roughly. In the second part the Shariyya Registration Books pertaining to Samsun and the studies made upon these were explained and the summaries of the judgments, which were written in the Shariyya Registration Books of Samsun, were given and interpreted. In the interpretition there is a stress upon the provinces, villages and quarters of Samsun and the things the people used, their clothings, what they lived on, their financial and social conditions, and after the expiations of works in the bibliography, which were used in this study, were made the transliteration of the original text starts. In the transliteration simple rules of that action were considered. At last the index of the transliteration was prepared and besides the names of places, peoples and (special) words especially, what the people of Samsun used, what they planted, dressed, which animals they fed and their movable and immovable properties added and the thesis was finished.
