Abstract

İslam düşünce sahasında bilgi üreten her ekol, ürettiği bilginin şer‘î hitap üzerinden sağlamasını yapmak durumunda kalmıştır. Tarihi seyir içerisinde ortaya çıkan İslam düşünce ekolleri, olgu ve olaylara karşı ortaya koydukları sistem içerisinde şer‘î hitap ile olan ilişkilerine göre tasnif edilmişlerdir. Buna göre akla verdikleri konuma göre bazı ekoller akılcı, diğer bazı ekoller ise literalist şeklinde konumlandırılmıştır. Akılcı ekollerin uç noktasını temsil eden Mu‘tezile, şer‘î hitaba karşı tutum ve tavırlarıyla akademik sahada merak konusu olmuş ve birçok açıdan mercek altına alınmıştır. Bu çalışmada, şer‘î hitabın anlaşılması meselesi Mu‘tezilî bir düşünür olan Kâdî Abdülcebbâr özelinde incelenmiştir. Mu‘tezilî düşüncenin tarih sahnesinde yeniden canlanmasında önemli role sahip olan baba-oğul Cübbâîler ve Ebu Abdullah el-Basrî gibi önemli âlimlerin temsilcisi kabul edilen Kâdî Abdülcebbâr, Mu‘tezile ekolünün zihin kodlarının günümüze taşınmasında önemli rol oynamıştır. Öncelikle şer‘î hitabın kavramsal çerçevesi çizilmiş ve Kâdî Abdülcebbâr’ın düşünce sistemi içerisindeki yeri ele alınmıştır. Daha sonra şer‘î hitabın anlaşılmasının teorik arka planı olan kelâmî ve dilsel arka plan incelenmiştir. Yapılan bu incelemeler sırasında Kâdî Abdülcebbâr’ın “hasen hitap” kuramı ortaya konulmuş ve çalışma boyunca bu kuramın Kâdî Abdülcebbâr’ın şer‘î hitabın anlaşılması noktasındaki etkisi takip edilmiştir. Daha sonra şer‘î teklife (hükme) kaynaklık yönüyle şer‘î hitabın kısımları olan emir ve nehiy formları incelenmiş ve emir ve nehyin mahiyeti ve şer‘î hükme delaleti gibi fıkıh usulünde tartışılan meselelere Kâdî Abdülcebbâr’ın yaklaşımı ortaya konulmuştur. Son olarak anlama delaleti cihetiyle şer‘î hitabın özellikleri ve kısımları incelenmiş ve dilin vazՙı itibariyle lafızların zâhir ve zahir olmayan, Şâriՙin irade ettiği anlama delaleti itibariyle şer‘î hitabın müstakil ve müstakil olmayan kısımları incelenmiş ve müstakil olmayan hitabın beyanı noktasında Kâdî Abdülcebbâr’ın yaklaşımı ortaya konulmuştur. Çalışmamız esnasında tespit edilen “hasen hitap” kuramının Kâdî Abdülcebbâr’ın şer‘î hitabın anlaşılmasına dair görüşlerine etkisi gün yüzüne çıkarılmıştır. Böylece Kâdî Abdülcebbâr’ın mezhebi aidiyetinin usul anlayışına etkisi ortaya konulmuştur.

Every school producing information in the Islamic thought has been obliged to ensure that the produced information is in concordance with shar’i address. The Islamic schools of thought emerging in the process of history have been classified according to their relations with the shar'i address within the system they put forth against phenomena and events. According to this, some schools have been defined as rationalist, while the others as literalist according to the value they have given reason. Mu’tazila, which represents the endpoint of the schools of rationalist schools has been an institution of wonder in academic field due to their attitudes and behaviours against shar’i address; and these schools have been scrutinized in many respects. In this study, the issue of understanding the shar’i address has been investigated specific to Qâdî Abd al Jabbâr, a Mu’tazila thinker. Qâdî Abd al Jabbâr, accepted as the representative of the most prominent scholars such as father-son Jubbâîs and Abu Abdullah al-Basrî, who have crucial roles in refreshing the Mu’tazilî thought in the stage of history, has played important roles in carrying the mental codes of Mu’tazila school today. Primarily, the conceptual framework of shar’î address was drawn, and its place in the thinking system of Qâdî Abd al Jabbâr was investigated. Afterwards, the kalamî and linguistic background of the comprehension of the theoretical bases of shar’î address was examined. During these examinations, “hasen address” hypothesis of Qâdî Abd al Jabbâr was put forth and throughout the work, the effect of this hypothesis on comprehending the shar’î address of Qâdî Abd al Jabbâr was pursued. Then, the command and prohibition forms, the sections of shar’î address in terms of being a source for shar’î provision, were investigated, and the approach of Qâdî Abd al Jabbâr to the issues such as the nature of command and prohibition being discussed to be the sign of shar’î provision in fiqh methodology was revealed. Finally, the features and sections of the shar'i address were examined; and with this, apparent and non-apparent sections and dependent and independent sections of shar’î address were investigated in terms of vaz’i and the sign Shari'ah’s view, respectively. With regard to statement of independent address, the approach of Qâdî Abd al Jabbâr was presented. In this study, the effect of the determined hypothesis, “hasen address”, on comprehending of the views of Qâdî Abd al Jabbâr was revealed. Thus, the effect of Qâdî Abd al Jabbâr's sectarian affiliation on his methodical understanding was put forth.
