Hukukun ekonomik kuramı bakımından rekabet oyununda örtülü muvazaa ve uyumlu eylem

Abstract

Oyun Teorisi aracılığıyla, ekonomik alanda yer alan aktörlerin davranışları anlaşılabilir hale gelmektedir. Bu nedenle kitap ve makalelerde sıklıkla ele alınan oyun teorisi tezimizin genel çerçevesini oluşturmaktadır. Bu çalışmada oyun teorisi rekabet hukuku ilişkilendirmesiyle ele alınmıştır. Rekabet Hukuku'nda önemli kavramlardan biri olan uyumlu eylem, çalışmamızda ana eksen olarak yer almaktadır. Bu noktada ilk olarak, Minmax Stratejisi, Nash Dengesi ve Mahkumların İkilemi ele alınmıştır. Söz konusu kavramlara ilişkin açıklamalar neticesinde örtülü muvazaa kavramına ulaşılmış, Bilinçli Paralellik kavramı ile ilişkisine değinilmiştir. İkinci aşamada Bertrand-Nash Dengesine ve Porter'ın genel maliyet üstünlüğü stratejisine ilişkin açıklamalar ele alınmıştır. Yapılan çalışma neticesinde görülmüştür ki, Oyun Teorisinin Rekabet Otoritesi tarafından hukuki bir çerçeve olarak kullanımı mümkündür. By means of the Game Theory, the behaviors of the actors which have part in the economic area become comprehensible. Hence, the game theory which is frequently considered in the books and articles forms the general frame of the thesis. In this work, game theory was considered with its competition law connection. Concerted practice which is one of the chief concepts in the competition law appears as a main axis in this work. In this point; firstly, Minmax Strategy, Nash Equilibrium and Prisoners' Dilemma were considered. Tacit collusion concept was come out as a result of explanations which are regarding to concepts stated above and in this context; the connection between tacit collusion and Conscious Parallelism was mentioned. In the second stage of the thesis; the explanations regarding to Bertrand-Nash Equilibrium and Porter's Cost Leadership Strategy were considered. It is observed as a result of this work that it is possible to utilize from the Game Theory by the Competition Authority as a legal frame.
