Publication: Ethical concerns of artificial intelligence use in the criminal justice system under EU law
Abstract
Yapay zekadaki (YZ) gelişmeler, AB'deki ceza adaleti sistemi de dahil olmak üzere çeşitli toplumsal alanlarda önemli dönüşümlere yol açmıştır. Tez, YZ teknolojilerinin AB'nin ceza adaleti süreçlerine entegrasyonundan kaynaklanan etik meseleleri araştırmaktadır. Tez, YZ'nin kolluk kuvvetlerinde, risk değerlendirmesinde, karar vermede ve hüküm vermede kullanımını analiz ederek, bu teknolojilerin konuşlandırılmasından kaynaklanan potansiyel zorlukları ve endişeleri irdelemektedir. YZ kullanımının temelini oluşturan etik çerçeveleri ve ilkeleri araştırmakta, YZ odaklı karar vermede adaletin, şeffaflığın, hesap verebilirliğin sağlanmasının ve ayrımcılık yapmamanın önemini vurgulamaktadır. Developments in artificial intelligence (AI) have led to significant transformations in several societal domains, including the criminal justice system in the EU. The thesis explores the ethical issues arising from integrating AI technologies into the EU's criminal justice processes. By analysing the use of AI in law enforcement, risk assessment, decision-making and sentencing, the thesis explores the potential challenges and concerns arising from the deployment of these technologies. It explores the ethical frameworks and principles underpinning the use of AI, emphasising the importance of ensuring fairness, transparency, accountability and non-discrimination in AI-driven decision-making. It also examines the role of human oversight, data protection and human rights considerations when using AI in the criminal justice context. By identifying the dilemmas and risks posed by AI, the thesis aims to contribute to the development of policy standards for an ethically sound and fair application of AI in the EU's criminal justice system.
