Abstract
Devlet ve Demokrasi 29 Kasım 2011’de kaybettiğimiz Prof.Dr. Server Tanilli’nin temel eserlerinden biridir. Anma toplantısında sunulan bu tebliğ söz konusu eseri temel almakta ve üç bölümden oluşmaktadır. İlk olarak bu eserden yola çıkarak Profesör Tanilli’nin anayasal yorum için önerdiği metot üzerinde durulacaktır. İkinci olarak, kendisinin, denge ve uzlaşma kavramları üzerine inşa ettiği demokrasi tanımı ince- lenecektir. Son olarak da Profesör Tanilli’nin anayasa değişikliklerine ve Türk Anayasacılığına bakış açısından örnekler verilmeye çalışılacaktır.
“The State and Democracy” is one of the major works of Server Tanilli who has passed away, November 29, 2011. Based on the mentioned work of Professor Tanilli, this paper is organized as follows: section 1 outlines the proposed methodology of the constitutional interpretation. Section 2 observes his definition of democracy built on the concepts as “balance” and “consensus”. Section 3 presents his remarks on Turkish constitutionalism and constitutional reforms.
