Publication: 6331 sayılı iş sağlığı ve iş güvenliği kanunu kapsamında işverenin yükümlülükleri
Abstract
6331 sayılı İş Sağlığı ve Güvenliği Kanunu ile sadece iş sağlığı ve güvenliğialanına ilişkin hükümleri içeren bir kanun yürürlüğe girerek, işçi-işveren veya memurayrımı olmaksızın tüm çalışanlar kanun kapsamına alınmıştır. Kanun genel itibariyleişverenin yükümlülüklerinden oluşmaktadır. Kanuna göre işveren, çalışanların işle ilgilisağlık ve güvenliğini sağlamakla yükümlüdür. İşveren iş sağlığı ve güvenliğininsağlanması için işyerinde her türlü tedbirin alınması, organizasyonun yapılması, gerekliaraç ve gereçlerin sağlanması, sağlık ve güvenlik tedbirlerinin değişen şartlara uygun halegetirilmesi ve mevcut durumun iyileştirilmesi için çalışmalar yapacaktır. Çalışmada,6331 sayılı İş Sağlığı ve Güvenliği Kanunu kapsamında işverenin sorumluluğu daincelenmiştir. Bunun yanında, işverenin iş sağlığı ve güvenliği kapsamındakiyükümlülükleri ilgili mevzuat açısından incelenmiş, özellikle iş sağlığı ve güvenliğibilincini oluşturmanın ve eğitimin önemi vurgulanmıştır.
With the law no 6331 Occupational Health and Safety Law, a law inured onlyabout occupational health and safety field, officer-workers or employer, withoutdistinction which includes all the workers. As well as within the scopeof legislation, the employers’ obligations in the field of safety and health were analysed,primarily the importance of creating occupational health and safety awareness and itstraining were emphasised.
