İHAM’IN İŞARET ETTİĞİ YAPISAL SORUN: ZORUNLU DİN EĞİTİMİ

Abstract

İHAM’ın Eylül ayı içinde verdiği zorunlu din eğitimi kararı, iç hu- kuk açısından belirleyici nitelikte bir yargı kararı olmasına rağmen sa- dece politik eksende tartışılmış olup din eğitimi ile ilgili mevcut düzen- lemeler ve konu hakkında daha önceden verilen mahkeme kararları üze- rinde fazla durulmamıştır. Oysa Türkiye’de din eğitimi İHAM kararında da vurgulandığı gibi uzun bir geçmişe dayanan yapısal bir problem olup zorunlu eğitime ilişkin sistemde politik gerekçelerle yapılan değişiklik- lerle daha da sorunlu bir hal almıştır.

ECHR’s compulsory religious education decision which was handed down in September, has been only discussed in a political axis without considering earlier court decisions and current regulations on the topic, although it is a important judicial decision that should determine national law. However, religious education in Turkey is a stuctural problem which is based on a long history as highlighted in EUCR decisions and it has become more problematic with the changes in the system of compulsory education which were made for political reasons.
