İMAR KISITLAMALARI VEMÜLKİYET GÜVENLİĞİ

Abstract

Yasal dayanağını Anayasa’dan alan kent planlama, İmar Kanunu ile ayrıntılıolarak düzenlenmiştir. Zemin etüdü vb. bilimsel nesnel yaklaşımlara dayanmayan vehalkın katılımı ile kararlaştırılmayan plan uygulamaları sosyal adalet duygusununzedelenmesine yol açmaktadır. İmar kısıtlamalarının uzun sürmesi mülkiyet hakkınızedelediği ve hak ihlaline neden olduğu AİHM içtihatları ile kesindir. Bu durumplanlamanın oluşturduğu kısıtlamaları arttırmaktadır. Kısıtlamaların artması imarplanlama ve mülkiyet güvenliğini ve sonuç olarak hukuk güvenliğini zedelemektedir.Mülkiyet ve hukuk güvenliğini sağlamak amacıyla planlamada nesnel yaklaşımlarınhalk katılımıyla uygulanması yönünde yasal düzenlemeler yapılması uygun olacaktır.

Urban planning, which takes its legal basis from the Constitution, is regulated in detail by the Construction Law. Development plan applications without scientific approaches such as land survey, and not agreed with the public participation lead to impairment of social justice. It is certain by the case-law of the ECtHR that the prolonged duration of the restrictions on the development damages the property right and causes violations of rights. This situation increases the limitations created by the planning process. Increasing limitations impair construction planning, property security, and legal security. It will be appropriate to make legal regulations to prevent these limitations and to ensure the implementation of objective approaches and public participation in planning to guarantee property and legal security
