GÖREVE İLİŞKİN SIRRIN AÇIKLANMASI SUÇU (TCK m.258)

Abstract

Bu çalışmada, 5237 sayılı TCKnun 258 inci maddesinde yer alan göreve ilişkin sırrın açıklanması suçu incelenmiştir. Maddede görevi nedeniyle kendisine verilen veya aynı nedenle bilgi edindiği ve gizli kalması gereken belgeleri, kararları ve emirleri ve diğer tebligatı açıklayan veya yayınlayan veya ne suretle olursa olsun başkalarının bilgi edinmesini kolaylaştıran kamu görevlisine, bir yıldan dört yıla kadar hapis cezası verileceği öngörülmüştür.

In this study, the crime of disclosure of office secrets which takes place in the Article 258 of Turkish Penal Code, was examined. In this article, any public officer who discloses or publicize the confidential documents, deci- sions and orders and other notifications delivered to him by virtue of office or facilitates access to such information and documents by third parties, is punished with imprisonment from one year to four years.
