dc.description.abstractAfter various accidents like the plane crash of Germanwings it was heatedly discussed within German literature whether a compensation for the pain and suffering of relatives would be needed in the German law. In 2017 the legislator passed a new regulation concerning the bereavement damages of relatives and dependants in 844 section 3 BGB (German Civil Code). The present article compares the compensation for the pain and suffering of relatives according to Turkish law with the damage claim caused by shock and the bereavement damages according to German law. In this context, the views in literature on the introduction of a compensation for the pain and suffering of relatives into German law is being described.
