EGEMEN EŞİTLİK PRENSİBİNE MODERN ULUSLARARASI HUKUK AÇISINDAN BİR İSTİSNA HALİ OLARAK YAKLAŞMA

Abstract

Uluslararası hukukun temel taşlarından biri olan devletlerin egemen eşitliği prensibi modern uluslararası hukuk doktrininde sıkça tartışılan konular arasındadır. Soğuk Savaş döneminin bitimi ile beraber devletin iç meselesi kavramının farklı yorumlarının ortaya çıktığı görülmektedir. Egemen eşitlik prensibinin asıl problemi de budur. Devletin egemenliğinin sınırlarını tespiti giderek daha çetrefilli bir soru haline gelmektedir. Başarısız devlet, insani müdahale ve koruma sorumluluğu gibi yeni uluslararası hukuk terimleri bir istisna durumuna işaret etmektedir. İstisna durumunu belirleme yetkisi ise egemene aittir.

The Principle of sovereign equality which is a basic Stone of international law is one of the prominent subject which is frequently discussed. With the end of the Cold War, it is easy to observe that new interpretations of the concept of domestic issue of the state occurred. This fact is the main problem of the principle of sovereign equality. Delimitation of the boundaries of the sovereignty of state has became a Gordian knot. The new concepts of international law like failed state, humanitarian intervention and responsibility to protect indicate a state of exception. The competence of determination of the state of exception belongs to sovereign itself.
