Publication: Takdir marji doktrini ve Türkiye anayasa mahkemesi açısından anlamı
Abstract
İnsan Hakları Avrupa Mahkemesi içtihatlarındaki takdir marjı doktrininin Türkiye Anayasa Mahkemesi tarafından da kullanılmaya başlandığı gözlemlenmektedir. Anayasa Mahkemesi, İHAM’ın Söz- leşme’ye taraf devletlerin takdir marjı içinde gördüğü konularda aynı takdir marjını yasama organına bırakma eğilimindedir. Bu makalede söz konusu doktrinin ECHR içtihatlarındaki gelişimi ve onu ortaya çıkaran nedenler üzerinde durulmuş ve bu doktrinin Ana- yasa Mahkemesi’nin anılan şekilde kullanımına uygun olup olmadığı sorgulanmıştır. Makalede ulaşılan sonuç şudur: İHAM, bu marjı taraf devletlere bırakmaktadır. Yargı yetkisi ise, tıpkı yasama ve yürütme gibi bu marjdan yararlanabilir. Bu nedenle söz konusu doktrinin anayasa şi- kâyeti yargılamalarında aynen kullanılması mümkün değildir.
The Constitutional Court of Turkey has started to use the margin of appreciation doctrine, which is part of the European Court of Human Rights jurisprudence. The Court tends to adopt the same margin of appreciation as the European Court grants to the legislatures of contracting states. In this article the development of the doctrine in ECHR jurisprudence is discussed and the reasons for it are emphasized. It is questioned whether it is appropriate for the Constitutional Court to use the doctrine. The conclusion is that the ECHR recognizes the margin of appreciation as a doctrine applicable not only to legislative bodies, but also to other authorities of the contracting states. The judiciary can use the doctrine in the same way as the legislature and executve. Therefore, it is not possible to use the aforementioned doctrine verbatim for the proceeding of constitution complaint.
