BAŞARISIZ DEVLET KAVRAMININ İNCELEMESİ

Abstract

Uluslararası hukuk terminolojisinin dinamik yapısı uluslararası hukuk doktrinini yeni kavramlarla yüzleştirmektedir. Doktrinin karşılaştığı yeni kavramlardan biri de başarısız devlet tir. Başarısız devlet kavramı özellikle Afrika ve Ortadoğu ülkelerinde meydana gelen şiddet olayları ile daha fazla gündeme gelmektedir. Kavramın hukuki sorgulamasının yapılması çok önemlidir. Bununla birlikte kavramın ortaya çıkış nedenlerinin araştırılması gerekmektedir. Uluslararası barış ve güvenliğin yüzleştiği yeni tür tehditler başarısız devlet kavramı gibi yeni kavramların türemesinin asıl sebebidir. Bu noktada kavramın amacının sorgulanması hayati önem taşımaktadır.

Dynamic structure of terminology of international law confronts the international doctrine with new concepts. Failed state is one of the new concepts that doctrine met. More and more, the concept of failed state be- came a current issue due to raising violence. It is very important to examine the concept in a legal perspective. In addition to that, it is required to examine the reasons which gave the way for the birth of this concept. The threats that international peace and security are confronted with, are the main reason which caused the spring-up of new concepts like failed state. In that point, examination of the main aim of the concept is of vital importance.
