Abstract
Karşılıksız yararlanma suçu, gerek 765 ve gerek ise 5237 sayılı Kanunlarda düzenlenmesi bakımından çeşitli tartışmalara neden olmuştur. Bu tartışmalar genel olarak suçun dolandırıcılıktan ayırt edilebilmesi ve bazı fiillerin özel hukuk alanına dahil edilmesine ilişkin olmuştur. Yargı kararları ve doktrinde 6352 sayılı Kanun yasalaşıncaya kadar uzun bir süre tartışma konusu olan husus ise, ekonomik bir değer taşıyan her türlü enerjinin de taşınır mal sayılacağı ve hırsızlık suçunun konusunu oluşturabileceği hususudur. Bu nedenle bu makale ile, son değişikliklerle beraber karşılıksız yararlanma suçunun değerlendirilmesi ve eleştirilmesi amacı üzerinde yoğunlaşılmıştır.
The ofence of benefiting from a service without compensation is legisla- ted in each Turkish Criminal Codes no. 765 and 5237 and woke controversy about how should ofence of benefiting from a service without compensation separate from ofence of fraud and some acts should consider in civil case or not. The core point in court s decisions and jurisprudence is that, until the code no. 6352 was codified, if all kinds of energy with economic value is also considered movable property and this kind of act should punish for ofence of larceny. The aim of this article is to review and criticise the ofence of benefiting from a service without compensation with the last codifications.
