Büyükşehir Belediye Meclislerinde Temsil Sorunu ve Meclis Üyelerinin Üstlenebilecekleri Görevlerdeki Orantısızlık

Abstract

Türkiye’de büyükşehir belediye meclislerinin oluşumunda ilçe belediye başkanlarının doğal üye olması ve ilçe belediye meclis üyelerinin beşte birinin ise büyükşehir belediye meclis üyesi olması hususu düzenlenmiştir. Bu kapsamda makalede büyükşehir belediye meclis üyelerinin kurumsal aidiyet sorunu yaşayabileceklerine, bunun da temsilde sorunlara sebep olacağına dikkat çekilmektedir. Ayrıca hem ilçede hem de büyükşehirde aynı anda üstlenilen çok sayıdaki görevin neden olabileceği orantısızlığa vurgu yapılmaktadır. Makale kapsamında ilçe belediyesinde bir görevin üstlenilmesi halinde gerek aynıtüzel kişilik içerisinde gerekse büyükşehir belediyesinde üstlenilemeyecek olan görevler anlamında herhangi bir yasaklayıcı müeyyidenin bulunmadığı tespit edilmiştir. Bu husus dikkate alınarak makalede her iki tüzel kişilik uhdesinde bir meclis üyesinde birleşemeyecek olan görevler tespit edilerek büyükşehir belediye meclisinde yaşanan coğrafi ve siyasi temsil sorununun yarattığı ve idarenin işleyişine sirayet eden sakıncaları giderici önerilerde bulunulmuştur.

The issue of the mayors of district municipatilies should be unconditioned members and one fifth of the council members of district municipality should be members of the metropolitan municipality council has been arrenged in Turkey. Within this framework, it is drawn attention that the members of the metropolitan municipality council would have corporate belonging trouble and consequently that may cause some issues in representation. It is also emphasized that assuming a great number of duties at the same time both in district and municipality may cause disproportion. Within the scope of the study, -in the act of undertaking a duty- it is determined that there is any prohibitor sanction of the duties which is not going to be undertaken within metropolitan municipality and legal entity. Taking account of this matter; Proposals, which functions as a corrector for geographic and politic drawbacks that pose as problems in the metropolitan municipality council and enure the running of executive, have been suggested in the article by makingfirm of duties which may not combine into a council member under both legal entities’ responsibilities
