İflas Tasfiyesinde Geçici Dağıtma

Abstract

İflas tasfiyesinde müflisin haczi mümkün olan bütün malvarlığı kural olarak tasfiyeye dahil olur. Bunedenle iflas tasfiyesi uzunca bir zamanı gerektirebilir. Tasfiye devam ederken iflas masasındaki bazımalların satışı yapılmış ama bazı mallar henüz satılamamış olabilir. Bunun yanında iflas alacaklılarınailişkin davalar henüz sonuçlanmamış olabilir. İşte bu durumlarda satış sonucu elde edilen paranınbekletilmesi iflas alacaklılarının zararına olur. Bu nedenle kanun bu durumlarda elde edilen paranınalacaklılara dağıtılabilmesi için geçici dağıtma imkanı getirmiştir. Bu çalışmada geçici dağıtma-kesindağıtma kavramları, bunlar arasındaki farklar, geçici dağıtmanın şartları ve geçici dağıtmanın sonuçlarıüzerinde durulmuştur. Geçici dağıtma kararının sonuçlarına değinilirken, geçici dağıtma kararınınalacaklılar toplanmasına etkisi, iflas masasına geç başvuran alacaklıların durumu irdelenmiştir.

In bankruptcy in liquidation, all seizable assets of insolvent detor are included in the liquidation. For this reason bankruptcy liquidation may last a long time. While the liquidation proceeding, although some of the goods in the bankruptcy estate are sold, some goods may not be sold yet. Besides cases against bankruptcy creditors may not yet be finalized. In these cases, holding money after sales causes disadvantage of bankruptcy creditors. Therefore, the law provides a rule for temporary payment of the money to the creditors. In this study, the concept of temporary payment and final payment, differences between these concepts, the conditions of temporary payment and the results of temporary payment is studied. While studying on the results of temporary payment, the effect of temporary payment decision on creditor’s meeting and status of creditors who apply late to the trustees in bankruptcy is also examined.
