Abstract
Temmuz 2016’daki askeri darbe girişimini takiben, Türkiye’deolağanüstü hâl ilan edildi. Böylesi istisnai bir rejimin ilan edilmesininamacı, terörizm tehdidi ile mücadele olsa da alınan tedbirlerin tamamıylagerekli ve ölçülü olmaktan uzak olduğu ve bazı tedbirlerin vatandaşlarınhaklarını ihlal ettiği görülmektedir. Yargı bağımsızlığının muhafazaedilmediği bu ortamda, Türkiye’deki başvurucular ulusal düzeyde haklarını aramaktan yoksun bırakılmış gözükmektedirler ve İnsan HaklarıAvrupa Mahkemesi bu hususa dair çekingen bir tutum sergilemektedir.
Following the July 2016 military coup attempt, a state of emergency has been proclaimed in Turkey. While the proclamation of this exceptional regime was supposed to prevent the terrorist threat, the measures adopted are far from being necessary and proportionate and lead to massive violations of human rights. In this context, the independence of the judiciary has not been preserved. Turkish citizens seem powerless to challenge violations of their rights because of the lack of effective domestic remedies and the timid approach of the European Court of Human Rights.
